1. How it Works

PumpSpace is the best place to discover (and launch) the next trending token (“Collection”). All Collection creations are fair—meaning, there is no pre-sale, no insiders, and no fraudulent structures. All Collections have a fixed supply of one billion (1,000,000,000) tokens.

Each token is created by you when you initiate the creation of a smart contract on the selected public blockchain. Once you create the token, the code becomes self-perpetuating and cannot be changed by you or anyone else. The supply and trading mechanics of any token on PumpSpace follow the fixed transfer and exchange rules set by the blockchain protocol, which cannot be arbitrarily changed to prevent individuals from selling their tokens. But beware—prices could collapse anyway! That’s the nature of meme tokens, and you willingly accept all risks in participating. You agree not to hold PumpSpace responsible for any money you may spend and lose on tokens.

PumpSpace reserves the right, at its sole discretion, to modify information related to your token or restrict public access to the token if it detects or suspects that you are using the software interface for fraudulent purposes, in violation of the law, or in a manner that breaches these terms and conditions.

2. Access to and Use of PumpSpace

To access and use the PumpSpace interface, you will need to connect your token wallet. You are solely responsible for the security of your wallet and should operate it only with a private key(s) that you created. You must keep your private key(s) confidential and take reasonable measures to prevent disclosure of this information to others.

If you launch a token using the PumpSpace interface, you agree and promise:

i) All content you upload to the site is your own creation or under your ownership, and you warrant that it does not infringe on anyone else’s intellectual property rights;

ii) The content does not incite obscenity, hate, or violence toward any individual or group;

iii) You will not describe the token in a way that encourages any individual or group to participate in activities (such as adding utility to the token) that might generate long-term value for the token collection;

v) You will not access the site through automated or non-human means, such as a bot or script;

vi) You will not bypass or disable the security features of the site, nor attack the site or any underlying blockchain network or technology;

vii) You will not introduce any material that is malicious or technologically harmful to the site, its users, the blockchain, or any related functionalities;

viii) You will not deceive, defraud, mislead, or cause harm to others;

ix) You will not harm or disparage the reputation of the site or its owner;

x) You will not share illegal, harmful, fraudulent, or offensive content; use private information of third parties without consent; disclose confidential information without permission; or encourage others to engage in prohibited or illegal activities.

xi) You will not use the site to engage in illegal activities or to circumvent any laws.

You acknowledge that once a token is created, neither you nor the interface providers can undo its creation; however, the interface providers reserve the right to remove the token’s visibility, priority, or integration with the PumpSpace interface at any time.

3. Binding Agreement

By accessing the Collections Interface, you agree that you have read, understood, and are bound by all of these Terms of Use. If you do not agree with these Terms, you agree not to use the Collections Interface. You also agree not to hold the Interface Providers responsible for any loss resulting from your use of the Collections Interface.

Additionally, you may not use our site if: (A) you are not at least eighteen (18) years old or of legal age to form a binding contract; (B) you are located in or a resident of any country where the use of the site is illegal or impermissible; or (C) accessing or using this site or any of its functionalities is prohibited by these Terms or by applicable law.

Supplemental terms and conditions or policies, such as our Privacy Policy, that may be posted on the site are incorporated into these Terms by reference, and you agree to be bound by such supplemental terms and policies. We reserve the right, at our sole discretion, to make changes or modifications to these Terms at any time. We will notify you of any changes by updating the “Last updated” date of these Terms of Use and providing other appropriate notifications. You agree that your use of the site will be subject to the most current version of these Terms at the time of such use.

4. Interface Provider Obligations

PumpSpace strives to keep the interface available at all times; however, access may be temporarily suspended due to maintenance, attacks, other threats, or unforeseen events.

5. Modifications and Interruptions

We reserve the right to change, modify, update, suspend, or discontinue the site at any time, for any reason, at our sole discretion. However, we have no obligation to update any information on the site. We are not liable to you or any third party for any modifications, price changes, suspensions, or discontinuations of the site.

6. Fees

The interface providers charge transaction fees on all trades conducted through the site. We reserve the right to change these fees at any time.

7. Privacy Policy

By using the site, you agree to be bound by the Privacy Policy posted on the site.

8. Term and Termination

These Terms shall remain in effect while you use the site. Without limiting any other provisions of these Terms, we reserve the right, at our sole discretion, to restrict, deny, or terminate your access to and use of the site or to delete any content or information you have posted, at any time and without notice. If we block your access to the site, you may not circumvent it, even if acting on behalf of a third party. We reserve the right to pursue appropriate legal action, including civil, criminal, and injunctive remedies.

9. Blockchain Risks

Blockchain technology carries relatively high risks in terms of security, financial, technical, political, and social aspects. Crypto-assets, including tokens, may have no present or future value and are highly volatile due to various factors, including use and adoption, speculation, manipulation, technology, security, and legal and regulatory developments. You understand that the transparency of blockchain means your interactions may be publicly visible and displayed in human-readable form.

You represent that you understand the risks associated with blockchain technology and token purchases, including vulnerabilities to hacking and potential loss of funds.

10. Warranty Disclaimer

The site is provided on an "as-is" basis. You agree that your use of the site and our services is at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and its use.

No Professional Advice. Content and information provided on the site are for informational purposes only and should not be construed as professional advice (including tax, legal, or financial advice). No Fiduciary Duty. These Terms do not create any fiduciary duties between you and us or any third party.

11. Limitation of Liability

To the fullest extent permitted by law, we, our affiliates, and our or their directors, officers, employees, and agents shall not be liable to you or any third party for indirect, consequential, exemplary, incidental, special, or punitive damages.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, claim, or demand arising from your use of the site, including any claims made by third parties.

13. Miscellaneous

a. Taxes. You are solely responsible for identifying, calculating, reporting, and remitting any and all taxes related to your token(s) that may apply to your use of PumpSpace.

b. Severability. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, the remaining provisions will remain in full force and effect.

c. Waiver. The waiver of a breach of any term hereof will in no way be construed as a waiver of any other term or breach hereof.

d. Entire Agreement. These Terms represent the entire understanding of the parties regarding their subject matter and supersede all prior or contemporaneous communications, whether oral or written.

e. Headings and Interpretation. The headings and summary explanations at the beginning of each section of these Terms are for reference only and do not affect the parties’ rights and obligations hereunder. As used herein, “may” means “has the right, but not the obligation, to,” and “includes” and its variations mean “includes, but is not limited to.”

f. Electronic Communications, Transactions, and Signatures. Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email, and on the Site, satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, orders, and other records, and electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the Site. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction that require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.
